Ministry seeks feedback on proposed TRESA reforms

On August 24, the Ministry of Public and Business Service Delivery and Procurement (MPBSDP) launched a public consultation on proposed legislative and regulatory changes to the Trust in Real Estate Services Act, 2002 (TRESA). The Ministry is seeking feedback from the real estate services sector and the public on the proposed changes.

 The consultation includes proposed changes related to:

  • Compliance and enforcement tools, including administrative penalties, freeze orders and compliance orders;
  • Brokerage accountability and oversight, including requirements for brokerage policies and a proposed managing broker registration class; and
  • Trust account oversight and financial accountability, including trust account requirements, annual financial filings and trust reconciliations reporting.

We encourage stakeholders and members of the public to review the proposed changes and provide feedback to MPBSDP at TRESA@ontario.ca before the consultation closes at 11:59 p.m. on September 18, 2026.
